Section 4
<br> to be withheld or controlled
In spite of anything written in the existing law, in the course of the investigation of the offence, the property obtained from the offense or the instrument related to the offense has reasonable grounds to suspect that the property or instrument is in the name, possession, ownership or any kind of right or interest of any person. However, it can be stopped or controlled immediately.
(2) If the property or instrument mentioned in sub-section (1) has been hidden, used, disposed of (disposal) or cannot be retained or controlled for any other reason, the investigating officer may consider the prevailing value of such property or instrument of the person suspected to have committed an offence. Property should be withheld or taken under control.
(3) According to sub-section (1) or (2), the investigating officer may do the following in relation to the seizure or seizure of property or means:-
(a) taking control of such property or instrument himself or issuing an order to take control through the relevant government agency, or
(b) To issue an order to unilaterally withhold such property or instrument without giving any notice to the concerned person and send it to the relevant body in writing.
(4) In the event that a written order has been sent to detain assets or instruments in accordance with clause (b) of sub-section (3), the person, entity or organization that takes over or controls such assets or instruments shall not transfer, mortgage or pledge, sell or distribute those assets or instruments. (5) If any property or instrument is seized or seized in accordance with this section, the investigating officer shall inform the concerned person within three days.
(6) If it is found that someone is trying to create any contractual or other liability in such a way as to adversely affect the confiscation of assets or instruments that may be confiscated in accordance with Section 11, the investigation officer shall have the right to take necessary action to stop such action or, if it has already been done, to cancel such action.
(7) Research AssistantIf the Ikari seizes or withholds the property or means in accordance with this section, he shall submit a report of the matter to the court within seven days from the date of doing so.
(8) If a report is received in accordance with sub-section (7), the court may issue other necessary and appropriate orders in this regard.
